Florian Sohnke of Chicago Contrarian said on Feb. 23, 2026, that recent federal findings regarding Illinois’ non-domiciled commercial driver’s license (CDL) program are alarming and supported the Illinois Department of Transportation (IDOT) pressing the Secretary of State’s office to halt further issuances until the Federal Motor Carrier Safety Administration (FMCSA) confirms compliance steps.

The issue has drawn attention after a U.S. Department of Transportation review found serious compliance issues with Illinois’ non-domiciled CDL program and warned that the state has 30 days to come into compliance and revoke improperly issued credentials or risk losing about $128 million in federal highway funding. The announcement said the audit examined whether federal safety rules were being followed, according to the U.S. Department of Transportation.

“Some of these findings are shocking. I am relieved beyond words IDOT has demanded Alexi Giannoulias’ SoS office to halt the issuance of non-domiciled CLPs and CDLs until FMCSA can confirm the SoS’ office has applied a news plan… The problem is licenses have already been issued and we’ve seen the consequences to the issuance of CDL licenses in other states. In several instances, foreign-born drivers have caused some serious automobile collisions on freeways… My first reaction is to ask myself why individuals with know known place of birth are being issued licenses in our state, my first instinct is to prohibit the approval of any license to operate any motor vehicle in our state… Illegals should not be licensed drivers in this state,” Sohnke said according to Chicago Contrarian.

Trucking Dive reported FMCSA audited a sample of 150 out of 10,088 non-domiciled CDLs issued by Illinois’ Secretary of State and found 29 in the sample failed to comply with federal requirements—an outcome tied by the agency to potential loss of Department of Transportation funding. The story notes that the audit was based on a targeted sampling approach and federal compliance criteria, as reported by Trucking Dive.

A Federal Register rule published Feb. 13, 2026 reaffirmed stricter federal requirements for states issuing non-domiciled CDLs or commercial learner’s permits (CLPs), including tighter eligibility and clearer standards for state driver licensing agencies administering these credentials. The rule is framed as restoring integrity to the issuance process and references updates following a Sept. 29, 2025 interim final rule, according to <a href="https://www.federalregister.gov/documents/2026/02/13/2026-02965/restoring-integrity-to-the-issuance-of-non-domiciled-commercial-drivers-licenses-cdl”>the Federal Register.
