Illinois has enacted laws such as the Illinois TRUST Act and the Illinois Way Forward Act, which limit cooperation between local police and federal immigration agencies. These laws generally prohibit officers from enforcing civil immigration law or honoring detainers solely on that basis. Updated guidance from the state attorney general advises agencies that immigration status and potential deportation are not lawful reasons for arrest or detention and cautions against sharing information that could aid federal enforcement. According to ICE officials, Illinois’ sanctuary policies have had tangible effects. They cite data indicating that since early 2025, state and local authorities have released 1,768 criminal aliens with active federal detainers despite repeated requests for their transfer to ICE custody. These releases reportedly involve offenders linked to violent crimes such as homicide, sexual assault, and kidnapping, along with others convicted of serious burglary and weapons offenses. ICE further reports that over 4,000 additional criminal aliens with detainers remain in Illinois facilities and warns that releasing them without notice compels agents to locate them within the community, a practice officials argue increases public safety risks and undermines overall immigration enforcement efforts.

Nationally, the Department of Homeland Security (DHS) has highlighted Illinois in a broader debate with sanctuary states regarding cooperation on deportations. A recent Reuters summary of DHS warnings to California, New York, and Illinois noted that federal agencies recorded over 400,000 arrests of undocumented immigrants this year; approximately 70 percent had criminal records or pending charges. Homeland Security officials contend that when states decline to notify ICE about releases or honor detainers, these individuals reenter local communities instead of being transferred directly into federal custody. This situation forces the government to allocate additional resources for at-large arrests. Enforcement advocates argue this dynamic justifies increased federal pressure on states limiting collaboration.
