Illinois Sen. Cunningham renewable energy planning bill passes House and Senate

Passed bill authored by State Sen. Bill Cunningham aims to give the Illinois Commerce Commission more flexibility in hiring experts for renewable energy and transmission planning, according to the Illinois General Assembly.

In the House, 70 Democrats voted in favor of the bill, while 35 Republicans opposed it.

Meanwhile, in the Senate, 35 Democrats and six Republicans voted in favor of the bill, while 12 Republicans voted against it.

Cunningham introduced the bill in the Illinois Senate on Feb. 3, 2026 during the 104th session.

The legislation, known as SB3272, was passed on May 21, 2026 during the general assembly session 104.

According to the Illinois General Assembly site, the legislature summarized the bill’s official text as follows: “Amends the Public Utilities Act. Provides that, to assist and support the Illinois Commerce Commission in the development of renewable energy access plan updates, the Commission may retain the services of technical and policy experts with relevant expertise and experience. Provides that the procurement is exempt from the requirements of the Illinois Procurement Code. Amends the Illinois Procurement Code to make a conforming change. Effective immediately.”

In essence, this bill allows the Illinois Commerce Commission to hire technical and policy experts with relevant experience to help develop updates to the state’s renewable energy access plan and related transmission planning work. Lawmakers listed as “Not Voting” were present for the vote but did not cast a vote. Those marked as having an “Excused Absence” were not present and formally provided a reason for their absence, which was accepted.
