Illinois Sen. Johnson’s community association collection policy bill passes House and Senate

Passed bill authored by State Sen. Adriane Johnson aims to require community associations to establish written policies for collecting unpaid assessments before pursuing legal action, and to include these policies in resale disclosures, according to the Illinois General Assembly.

In the House, 72 Democrats and 36 Republicans voted in favor of the bill.

Meanwhile, in the Senate, 37 Democrats and 17 Republicans voted in favor of the bill.

Johnson introduced the bill in the Illinois Senate on Feb. 5, 2026 during the 104th session.

The legislation, known as SB3527, was passed on May 21, 2026 during the general assembly session 104.

According to the Illinois General Assembly site, the legislature summarized the bill’s official text as follows: “Amends the Common Interest Community Association Act and the Condominium Property Act. Requires an association under both Acts to adopt policies and procedures concerning the collection of unpaid assessments. Prohibits an association or a holder or assignee of the association’s debt from taking legal action to collect common expenses unless the association has adopted a written policy governing the collection policy for unpaid assessments. Specifies what the policy, at a minimum, must contain.”

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill amends the Common Interest Community Association Act and the Condominium Property Act to require associations to adopt and follow a written policy for collecting unpaid assessments before taking legal action to recover common expenses. The policy must define when assessments are due and delinquent, allowed late fees, interest and returned-check charges, when and on what terms owners may enter payment plans, when delinquent accounts are referred to attorneys, how payments are applied, and the legal remedies available under governing documents and Illinois law. The bill also adds these written collection policies to the resale disclosure documents provided to prospective purchasers.

The bill was sponsored only by Rep. Daniel Didech (Democrat-59th District).

Bills in Illinois follow a multi-step legislative process, beginning with introduction in either the House or Senate, followed by committee review, floor debates, and votes in both chambers before reaching the governor for approval or veto. The General Assembly operates on a biennial schedule, and while typically thousands of bills are introduced each session, only a fraction successfully pass through the process to become law.

Johnson, a Democrat, was elected to the Illinois State Senate in 2020 to represent the state’s 30th Senate District, replacing previous state senator Terry Link.

Lawmakers listed as “Not Voting” were present for the vote but did not cast a vote. Those marked as having an “Excused Absence” were not present and formally provided a reason for their absence, which was accepted.
