The Illinois Senate passed Senate Bill 3114, known as the “Transparency in Downcoding Act,” on May 15 with a unanimous vote of 59-00. The bill is backed by the Illinois State Medical Society and aims to limit the practice of automatic downcoding by health insurers.
Downcoding is a process where insurers reduce reimbursement amounts for medical services, which can affect physician payments and the financial stability of medical practices. The proposed legislation would require that physicians’ clinical notes are reviewed and considered when decisions about downcoding are made. It also mandates that physicians be notified if their claims are downcoded, including an explanation of the clinical justification.
Senate Bill 3114 includes provisions allowing physicians to appeal downcoded claims. Supporters say these measures will provide more transparency and fairness in how insurance companies process medical billing.
The bill has now moved to the Illinois House for consideration during the final part of this legislative session. According to the Illinois State Medical Society, efforts behind this legislation have been supported through a grant from the American Medical Association.
