The Illinois Department of Human Rights (IDHR) recently held a stakeholder meeting to review draft rules for a new law that will require employers to notify employees when artificial intelligence is used in employment decisions related to discrimination.
Noah Finley, State Director of the National Federation of Independent Business (NFIB) Illinois, and Cindy Neal, Chair of the NFIB IL Leadership Council and representative from Express Employment Professionals, took part in the discussion. They provided feedback on the proposed regulations.
The draft rules introduce expanded notification and record-keeping requirements for all employers in Illinois. Finley raised concerns about certain aspects of the proposal, stating that they do not sufficiently consider the limitations faced by small business owners. He argued that “the proposed rules imposed unreasonable burdens on Illinois’ small-business community.”
Neal contributed her experience as an employment professional, sharing practical considerations she believes should be included in the department’s rulemaking process.
The rules are being developed to implement Public Act 103-0804, which will take effect on January 1, 2026.
