Minutes of the Meeting held on November 19, 2020 via teleconference and web conferencing (Per the Gubernatorial Disaster Proclamation and Executive Orders issued in response to the COVID-19 pandemic, the Illinois Educational Labor Relations Board held its November 19, 2020 meeting by Webex.)
I. PRESENT
Board Member Lynne Sered; Board Member Gilbert O’Brien; Board Member Lara Shayne; Executive Director Victor Blackwell; General Counsel Ellen Strizak; Assistant General Counsel Dawn Harden; Staff Attorney Nick Gutierrez; Staff Member Eileen Brennan; Staff Attorney Tracey Trigillo; Springfield Staff Member Meredith Dean; Stephanie Winston, IEA; Nick Christen, IFT; Thaddeus Goodchild, CTU; Colin Burns.
II. OPENING REMARKS
Brief statement made by Board Member Sered regarding why the instant Board meeting was held via telephone and video conferencing rather than in-person.
III. APPROVAL OF MINUTES OF MEETING HELD October 15, 2020 and November 5, 2020 SPECIAL MEETING
Board member Sered called for a motion to approve the minutes from the October 15, 2020 Board Meeting and November 5, 2020 Special Meeting. Board Member Shayne so moved to approve the minutes of the October 15, 2020 Board meeting and November 5, 2020 Special Meeting. Board Member O’Brien seconded the motion. The Board passed the motion unanimously, by roll call vote.
IV. CASES
1. CTU, Local No. 1, IFT-AFT, AFL-CIO/Chicago Board of Education, Case No. 2021- CA-0043-C
Board Member Sered called the case. The case is before the Board pursuant to a request for preliminary injunctive relief and oral argument. General Counsel Ellen Strizak presented a draft opinion and order. After discussion regarding a footnote, Board member Sered called for a motion to adopt the General Counsel’s draft opinion and order with the noted typographical error corrected. Board Member Sered called for a motion for the Board to adopt and issue the opinion and order. Board Member Shayne so moved, and Board Member O’Brien seconded the motion. The Board voted unanimously to issue the opinion and order, by a voice vote.
2. Brzeski/Chicago Board of Education, Case No. 2019-CA-0082-C
Board Member Sered called the case. The case is before the Board on exceptions to the Executive Director’s Recommended Decision and Order. General Counsel Strizak presented a draft opinion and order based on the discussion during last month’s meeting. Board Member Sered called for a motion for the Board to approve and issue the draft opinion and order. Board Member Shayne so moved, and Board Member O’Brien seconded the motion. The Board voted unanimously to issue the opinion and order, by a voice vote.
V. FINAL ORDER CASES
1. Service Employees International Union, Local 73/Lyons School District 103, Case No. 2019-CA-0049-C
Board member Sered called the case. The case is before the Board on an unappealed Administrative Law Judge’s Recommended Decision and Order. General Counsel Ellen Strizak presented the case. After discussion, Board member Sered called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Shayne so moved, and Board Member O’Brien seconded the motion. The Board voted unanimously not to take the case up on its own motion and to issue a final order, by a roll call vote.
2. District 150 Educational Organization, IEA-NEA/South Holland School District 150, Case No. 2019-CA-0076-C
Board member Sered called the case. The case is before the Board on an unappealed Administrative Law Judge’s Recommended Decision and Order. Assistant General Counsel Dawn Harden presented the case. After discussion, Board member Sered called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Shayne so moved, and Board Member O’Brien seconded the motion. The Board voted unanimously not to take the case up on its own motion and to issue a final order, by a roll call vote.
3. Mid-Valley Special Education Cooperative/Mid-Valley Special Education Association, IEA-NEA, Case No. 2021-UC-0002-C
Board member Sered called the case. The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Dawn Harden presented the case. After discussion, Board member Sered called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Shayne so moved, and Board Member O’Brien seconded the motion. The Board voted unanimously not to take the case up on its own motion and to issue a final order, by a roll call vote.
VI. PUBLIC COMMENT

VII. BUDGET/FISCAL
Meredith Dean presented budget and fiscal information for FY21 and answered questions regarding the FY22 budget, as well as provided a SECA (State and University Employees Combined Appeal) campaign and audit update.
VIII. CASE STATUS REPORT
Executive Director Blackwell presented a monthly and 3-year Case Status Report. IX. STRIKE REPORT UPDATE
Executive Director Blackwell advised that the strike report was the same as last month.
X. LEGISLATIVE UPDATE
Staff Attorney Nick Gutierrez advised that there was nothing new to report at this time.
XI. JANUARY 2021 REGULATORY AGENDA
Staff Attorney Tracey Trigillo presented information on JCAR’s (Joint Committee on Administrative Rules) objection to the emergency rule, 80 Ill. Adm. Code 1100. Attorney Trigillo and General Counsel Strizak presented a draft January 2021 regulatory agenda. A discussion ensued and Attorney Trigillo and General Counsel Strizak answered questions from Board members. Board member Sered called for a motion to proceed with filing the regulatory agenda. Board Member Shayne so moved, and Board Member O’Brien seconded the motion. The Board voted unanimously by a roll call vote and the motion passed.
XII. LITIGATION UPDATE
General Counsel Strizak presented a litigation update on pending IL Supreme Court and Appellate matters.
XIII. AGENCY OPERATIONS
Executive Director Blackwell presented information on the current state of office operations in light of the COVID-19 pandemic.
XIV. 2021 BOARD MEETING DATES
Board member Sered called for a motion to adopt the 2021 Board meeting dates as drafted. Board Member Shayne so moved, and Board Member O’Brien seconded the motion. The Board voted unanimously by a roll call vote and the motion passed.
XV. ADJOURN
Board member Sered called for a motion to adjourn the Webex meeting. Board Member Shayne so moved, and Board Member O’Brien seconded the motion. The Board voted unanimously to adjourn the meeting, by roll call vote.
