Illinois Guardianship and Advocacy Commission Human Rights Authority Chicago Region met Nov. 1.

Here are the minutes provided by the commission:

PRESENT: Linda Cervenka, Jeff Gee, Alehae Khan, Marie Marasovich, Dallas Read and Daryl Richardson.

ABSENT: Gary Doherty and Jeremy Farmby.

STAFF: Jeremy Polk (Disability Rights Manager)

GUEST: N/A

The regularly scheduled meeting of the Human Rights Authority, Chicago Region was called to order at 5:09 p.m. by the Chicago Region Member Daryl Richardson.

It was determined that a quorum was present. The HRA did move into close session. The confidentiality statement was read by Jeremy Polk.

Minutes: Minutes for September approved. The motion to approval was entered by Jeff. The motion was seconded by Dallas. The motion carried with remaining votes.

Communications:

Informed members of new trainings that are to be completed annually. Also informed them that the Pandemic Emergency Order was extended by the Governor.

NEW BUSINESS

New Cases:

23-030-9006 – New Case – A complainant states that they were not explained their rights and retaliated against for speaking up about their living conditions. The complainant was then evicted from the shelter. The facility did not provide any mental health services to the complainant and the DRM did not find a suitable agency to investigate the complains. The HRA motioned to not accept this case as the HRA was not suitable to investigate the issues presented. The motion was entered by Marie. The motion was seconded by Jeff. The motion carried with remaining votes.

23-030-9011 – New Case – A patient indicated that they want to be discharged. The patient stated that they requested 5-day release and has not been discharged. DRM spoke with social worker who stated that the patient was discharged. DRM followed up for forwarding address. A forwarding address was provided, and the patient never reached back out to the DRM. The motion to not accept was entered by Marie. The motion was seconded by Linda. The motion carried with remaining votes.

23-030-9015 – Madden – A complainant states she would like to be discharge. DRM travelled to the facility and spoke with complainant. The complainant has a guardian and DRM followed up with social worker. Patient signed a 5-day request for discharge after being informed by the DRM; and the patient was discharged timely per Code. The HRA motioned to open and close as the case was handled by informal means. The motion was open and close informally was entered by Jeff. The motion was seconded by Linda. The motion carried with remaining votes.

23-030-9016 – Loren Half Robinson Foundation – A recipient states facility disclosed information without consent on 8/22/2022 to DCFS worker. The recipient stated that because of this she is being pressured to sign release and retaliated against. The DRM called the facility and the social worker there indicated that they provide substance abuse and mental health counseling to all participants. The motion to accept this case for investigation was entered by Marie. The motion was seconded by Dallas. The motion carried with remaining votes.

23-030-9017 – New Case - A patient indicated that they were a victim of identity theft and wanted to be discharged from a facility. The DRM attended the initial care plan meeting, and the patient was allowed to sign in voluntarily. The patient then requested discharged. DRM spoke with social worker who stated that the facility was seeking an inpatient treatment petition. DRM forwarded information to the LAS attorney. Petition was filed according to Code. Patient is not eligible for 5-day release. The HRA motioned to not accept this case as the patient was not eligible for a 5- day release. The motion was entered by Marie. The motion was seconded by Linda. The motion carried with remaining votes.

23-030-9018 – Jackson Park – A patient states he was transported to a facility via a petition for involuntary admission. The patient states that he was placed on a medical floor at the hospital and never signed into the facility voluntarily. The patient then indicates that he had a wound on his leg and discharged to the street inhumanely. The HRA motioned to accept this case. The motion was entered by Dallas. The motion was seconded by Marie. The motion carried with remaining votes.

23-030-9019 – New Case – A patient stated he was seeking discharge to a nearby shelter. The DRM met with the patient and spoke to the social worker. The patient was informed of the 5-day release for voluntary patients. The patient completed the discharge request and was discharge per Code requirements. The HRA motioned to open and close as the case was resolved by informal means. The motion was entered by Marie. The motion was seconded by Dallas. The motion carried with remaining votes.

23-030-9020 – New Case – A patient states that the facility has been refusing to feed and give snacks. She also requested discharge. DRM met with patient and informed patient of 5-day release. Patient was discharged timely per Code. DRM also spoke with social worker and dietary. Dietary provided lunch menu of all vegan options. The HRA motioned to accept this case. The motion was entered by Jeff. The motion was seconded by Marie. The motion carried with remaining votes.

UNFINISHED BUSINESS

The HRA moved into closed session pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2). The motion to enter closed session was initiated by Dallas. The motion was seconded by Jeff. The HRA entered closed session at 5:23 pm. The HRA exited closed session at 5:41 pm. During the closed sessions no votes were taken.

20-030-9001 – Jackson Park – The HRA motioned to accept the draft report without any issue. The motion to accept and issue the report was entered by Marie. The motion was seconded by Linda. The motion carried with remaining votes.

22-030-9020 – Univ of Chicago Student Wellness – The HRA motioned to accept the draft report without any issue. The motion to accept and issue the report was entered by Marie. The motion was seconded by Linda. The motion carried with remaining votes.

22-030-9025 – St. Mary’s – The HRA briefly discussed addressing the timelines for suicide prevention requirements as it pertained to psych evaluations in the policy of this Hospital. The HRA then motioned to accept and issue the draft report for this case. The motion to accept and issue the report was entered by Marie. The motion was seconded by Linda. The motion carried with remaining votes.

22-030-9025 – New City Supportive Living – The HRA motioned to accept the draft report without any issue. The motion to accept and issue the report was entered by Marie. The motion was seconded by Linda. The motion carried with remaining votes.

Other unfinished business, announcements and comments:

The HRA voted to remove Jeremy Farmby from the Chicago Regional Human Rights Authority Board.
