Illinois Guardianship and Advocacy Commission Human Rights Authority East Central Region met Nov. 17.

The regular meeting of the East Central Regional Human Rights Authority (HRA) was called to order at 3:00pm on Thursday, November 17th, 2022, at the State Office Building Conference Room B, 2125 South First Street, Champaign, IL 61820.

ROLL CALL

Present:

Adam Casario, Jim Jones, Janet Manning, Sandra Dixon, Dan McCarthy LaVeda Weidner-Cravens, Ingrid Wheeler, and Paulette Brock

Absent:

MaCaylynn Gant

Adam Casario stated that there was a quorum present.

Adam Casario read the confidentiality statement reminded everyone that personally identifiable information should not be presented in public meetings to protect the privacy of those persons with disabilities on whose behalf the HRA conducts investigations.

INTRODUCTIONS

MaCaylynn Gant introduced herself. She is a student at the University of Illinois. She is currently a junior and after graduation she plans to enroll to obtain her Masters. MaCaylynn stated she has a brother who is disabled.

COMMUNICATION:

The board decided on the 2023 meeting dates and times.

MINUTES

The September 2022 HRA Board Meeting Minutes were reviewed. LaVeda Weidner-Cravens motioned that the minutes be approved. Dan McCarthy seconded, and the motion carried.

New Business:

A. Ratifications:

None

B. New Complaints:

23-060-9002 (Nursing Home): The complaint alleges the facility will not allow the guardian to communicate with the individual's physician. Allegedly, the physician ordered the individual to get a flu shot after being told by the guardian that the individual does not want a flu shot. The complaint states the facility is not following the individual's treatment plan regarding the individual's dental care and dentures. Allegedly, the facility refuses to clean the individual's wheelchair claiming it is not their responsibility even though the individual is not able to clean it herself. The complaint alleges the guardian has requested the individuals records but the facility is refusing to provide all the records as requested. Dan McCarthy made a motion to not accept the complaint and due to lack of release. The motion was properly seconded by LaVeda Weidner-Cravens. Motion carried.

23-060-9003 (Hospital Psychiatric Unit): The complaint alleges the individual was transferred from the emergency room to a psychiatric unit against his will. Allegedly, the individual was not explained why he was being admitted into a psychiatric unit and he was not explained the admission process. The complaint alleges, the individual got into a verbal altercation with a staff member, who then forced medication upon the individual for cursing. Dan McCarthy made a motion to accept the complaint. The motion was properly seconded by Jim Jones. Motion carried.

Unfinished Business:

LaVeda Weidner-Cravens made a motion to enter executive session at 3:17pm. Pursuant to Section 120/2 (c) (4) and (10) of the Open Meetings Act (5 ILCS 20), Section 3955/10 of the Guardianship and Advocacy Act (20 ILCS 3955) and Section 110/5 of the Mental Health and Developmental Disabilities Confidentiality Act (740 ILCS 110); the motion was seconded by Janet Manning and carried. The purpose of the closed session was to discuss confidential aspects of cases. The HRA returned to open session at 3:52pm having taken no action in closed session. Executive minutes were recorded.

A. Draft Report:

22-060-9012 - The Pavilion - Adam Casario motioned to approve the draft report. The motion was properly seconded by Jim Jones. Motion carried.

22-060-9017 - ResCare - Jim Jones motioned to approve the draft report. The motion was properly seconded by Sandra Dixon. Motion carried.

22-060-9018 - St. Mary's Hospital Sandra Dixon motioned to approve the draft report. The motion was properly seconded by LaVeda Weidner-Cravens. Motion carried.

B. Case Closures:

22-060-9007 - ResCare - Paulette Brock moved to table the report and send a letter requesting the facility follow the recommendations. The Motion was properly seconded by Adam Casario. Motion carried.

22-060-9013 – Evergreen - Paulette Brock moved to close the report and make the report apart of the public record. The Motion was properly seconded by LaVeda Weidner-Cravens. Motion carried.

22-060-9014 - Effingham Rehab - Adam Casario moved to table the report and send a letter to the facility requesting a response to the report. The Motion was properly seconded by Dan McCarthy. Motion carried.

22-060-9015 - Lakeland LaVeda Weidner-Cravens moved to close the report and make the report apart of the public record. The Motion was properly seconded by Janet Manning. Motion carried.

22-060-9016 – KCTC – Adam Casario moved to table the report and send a letter to the facility requesting a response to the report. The Motion was properly seconded by Paulette Brock. Motion carried.

C. Other Business

LaVeda Weidner-Cravens motioned to adjourn the meeting. The motion was properly second by Janet Manning. Motion carried
