Illinois Guardianship and Advocacy Commission Human Rights Authority Chicago Region met March 14.

Here are the minutes provided by the commission:

PRESENT: Judi Bradley, Linda Cervenka, Gary Doherty, Tiffany Johnson, and Daryl Richardson.

ABSENT: Jeff Gee, Marie Marasovich, and Dallas Read

STAFF: Jeremy Polk (Disability Rights Manager)

GUEST: Robert Freitag (Clark Manor) and John Whitcomb (UofC)

The regularly scheduled meeting of the Human Rights Authority, Chicago Region was called to order at 5:16 p.m. by the Chicago Region Member Daryl Richardson.

It was determined that a quorum was present. However, the HRA did not move into close session. The confidentiality statement was read by Jeremy Polk.

Minutes: Minutes for January were approved. The motion to approval was entered by Judi. The motion was seconded by Linda. The motion carried with remaining votes.

Communications:

Informed members of new trainings that are to be completed annually. The members were also informed that the next meeting will be held on April 25, 2023. The DRM also informed members of in person meeting requirement.

NEW BUSINESS

New Cases:

23-030-9031 – New Case – A guardian states that a patient has received forced medication without cause. The guardian also reported that she was not included in the patient’s treatment plan. The DRM met with the patient and did learn that medication was given to the patient. The DRM is unaware if the patient or guardian consented to the medication. A release was forwarded to the guardian, but it was not returned for the HRA meeting. Motion to not accept due to not having a release was entered by Judi. The motion was seconded by Linda. The motion carried with remaining votes.

23-030-9034 – Madden Mental Health Center – A complainant states that she was petitioned by sister to the facility. She states that she signed paperwork indicating that she would not take any medications in an event of emergency but would like to be restrained. The complainant states that the facility disregarded her emergency treatment preference and provided forced medication without cause. The HRA motioned to open the case. The motion was entered by Linda. The motion was seconded by Judi. The motion carried with remaining votes.

23-030-9035 – New Case – An eligible member states she was subjected to inhumane treatment as there was a COVID outbreak in the facility and she was not notified. She also states that she was restrained by staff without cause and transferred to another psych facility for no reason. She furthered that she was injured by staff. The HRA forwarded the physical abuse complaint to the Illinois Department of Public Health. The HRA then motioned to not accept this case. The motion was entered by Gary. The motion was seconded by Judi. The motion carried with remaining votes.

23-030-9036 – Ascension St. Mary’s – A complainant states that GOD took control of his hands and signed his voluntary admission paperwork. After continuous calls the DRM instructed the complainant to complete a request for discharge. DRM then traveled to the facility and the complainant signed discharge request in front of DRM. The complainant then stated he received multiple issuances of forced medications for whistling. The HRA moved to open the case for forced medications without cause. The motion was entered by Linda. The motion was seconded by Judi. The motion carried with remaining votes.

23-030-9037 – New Case – Complainant states that he was subjected to admission based on his mother's false information He then asked about becoming his own guardian. DRM informed patient on how to request discharge. Complainant then indicated he wanted to help removing mother from being guardian. DRM spoke with SW and forwarded CCP-0211 to social worker. DRM then requested physician to fill out information and gave complainant update. This case was not accepted as the complainant’s issues is a guardianship issue. Motion to not accept was entered by Gary. The motion was seconded by Judi. The motion carried with remaining votes.

UNFINISHED BUSINESS

The HRA did not move into closed session pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2).

22-030-9016 – Univ of Chicago Medical Center – The HRA motioned to accept the draft report without any suggestions. The motion to issue the report was entered by Judi. The motion was seconded by Gary. The motion carried with remaining votes.

23-030-9007 – Saint Anthony – The HRA motioned to accept the draft report without any issue. The motion to accept and issue the report was entered by Tiffany. The motion was seconded by Gary. The motion carried with remaining votes.

23-030-9022 – Clark Manor – The HRA briefly discussed this report. The DRM indicated that the complainant in this case was assessed to need physical therapy. The facility agreed to consult with psych to get the complainant to adhere to a physical therapy session. DRM also reported to the HRA that complainant seeks to be transferred to a more intensive facility. The motion to accept and issue the report was entered by Gary. The motion was seconded by Linda. The motion carried with remaining votes.

Accept responses, close and publish:

22-030-9001 – Jackson Park – The HRA received the response for this case. The facility updated the admission and discharge policy. The facility also re-trained all admission staff on including surrogate decision makers and guardians in discharge planning. The motion to close and publish this case was entered by Gary. The motion was seconded by Judi. The motion carried with remaining votes.

22-030-9021 – Univ of Chicago Medical Center – The HRA motioned to close this case and publish the report without any suggestions. The motion was entered by Gary. The motion was seconded by Judi. The motion carried with remaining votes.

22-030-9025 – St. Mary’s – This case closed on this date. The facility retrained 90% of all available staff on code requirements for restrictions of rights and admission petitions. The HRA motioned to close and publish the case. The motion to was entered by Judi. The motion was seconded by Tiffany. The motion carried with remaining votes.

22-030-9028 – Thresholds – The HRA motioned to close and publish the case with the provider’s response. The motion entered by Gary. The motion was seconded by Judi. The motion carried with remaining votes.

22-030-9029 – Swedish Hospital – The HRA briefly discussed this report. The facility provided case information detailing that the patient was petitioned to be in the facility and a certificate was e mailed to the states attorney’s office. The facility requested an addendum be added to the report. The HRA tabled acceptance of report until addendum was added. The motion to table was entered by Tiffany. The motion was seconded by Gary. The motion carried with remaining votes.

22-030-9037 – St. Mary’s – This case closed on this date. The facility retrained 90% of all available staff on code requirements for restrictions of rights and admission petitions. The HRA motioned to close and publish the case. The motion to was entered by Judi. The motion was seconded by Tiffany. The motion carried with remaining votes.

22-030-9038 – Chicago Read – This case motioned to close and publish the report. The facility retrained all staff on protocols of restriction of rights and emergency issuances of medication. The motion to close and publish was entered by Judi. The motion was seconded by Gary. The motion carried with remaining votes.
