Illinois Guardianship and Advocacy Commission Human Rights Authority, Chicago Region Met March 23.

The regularly scheduled meeting of the Human Rights Authority, Chicago Region was called to order at 5:06 p.m. by the Chicago Region Member Dallas Read.
It was determined that a quorum was so the HRA did conduct regular business and advanced into closed session. The confidentiality statement was read by Jeremy Polk.
Minutes: Minutes for December and February were approved.
Communications: The HRA discussed the annual trainings. All previous actions were ratified during open session.
NEW BUSINESS
New Cases:
21-030-9010 – New Case – A patient reported that a hospital injected him illegally with medications on several occasions without reason. The patient also reported that he asked for the facility to honor his 5-day release and was given forced medications instead. Motion to not accept due to not having a release was entered by Daryl. The motion was seconded by Dallas and the motion carried with remaining votes.
21-030-9012 – New Case – A complainant called because he signed a five-day release on 1/3/21. Caller stated that the facility did not honor his request. The caller furthered that he was being discriminated against and given forced medication without cause. HRA Coordinator called facility to inquire about the complainant's 5-day request for release. HRA Coordinator contacted the SW. SW was not responsive. Complainant called several times throughout the week. HRA Coordinator attempted to visit complainant in the psych unit. The facility refused to allow Coordinator entry. Patient was discharged the very next day and the social worker contacted the HRA Coordinator notifying him of the discharge address. A release of information was sent on 1/21/2021. The HRA informed the DRM to contact the individual for a final time. Motion to table due to not having a release was entered by Daryl. The motion was seconded by Gary. The motion carried with remaining votes.
21-030-9014 – New Case – A detainee has sent the HRA coordinator has several letters from the complainant. The HRA attempted to open a case with the complainant years prior. The complainant never responded to request for release of information. The complainant reports that the staff of Cermak harasses, demean and are not given him adequate treatment in the least restrictive environment. The HRA coordinator mailed a new release 1/20/21. The HRA informed the DRM to contact the individual for a final time. Motion to table due to not having a release was entered by Gary. The motion was seconded by Dallas and the motion carried with remaining votes.
21-030-9016 – New Case – HRA coordinator received a call from a complainant. The coordinator visited the complainant in the hospital. The complainant indicated that he recently signed a 5-day request for discharge. The coordinator interviewed the complainant about the care received; the complainant was fixated on discharged only. The coordinator spoke with the risk manager and the risk manager agreed to look for when the 5-day was entered. The coordinator followed up with the risk manager on 03/01/21. There was no response from the risk manager. The HRA motioned to table this case due to not receiving a release. The motion was entered by Dallas. The motion was seconded by Gary and the motion carried with remaining votes.
21-030-9017 – Southview Manor – HRA coordinator received a call from a complainant. The complainant indicated that the facility that her brother lives in would not allow her to manage his funds as his legal guardian. Motion to open and accept for investigation was entered by Dallas. The motion was seconded by Gary. The motion carried with remaining votes.
21-030-9018 – New Case – Disability Rights Manager received letter from a complainant. The complainant indicated that while detained he is receiving the wrong medication and that the facility is not listening to him. The complainant also states that the facility has not kept him in a sanitary environment. Motion to table due to not having a release was entered by Gary. The motion was seconded by Dallas; the motion carried with remaining votes.
21-030-9019 – MacNeal Hospital – Complainant called due to receiving forced medications without cause. Complainant also stated he signed five day and it was not honored timely. The complainant stated that he had not been eating or sleeping for several days and was admitted voluntarily. He indicated that his mother appealed to him and went to the Hospital to satisfy her wishes. Motion to open for investigation entered by Gary. The motion was seconded by Daryl. The motion carried with remaining votes.
UNFINISHED BUSINESS
The HRA was moved into closed session pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2) at 5:27pm.

20-030-9011 – Center Home – The HRA did briefly discuss the case. There was an investigation conducted by IDPH. A motion to accept and close was entered by Gary. The motion was seconded by Shelia and the motion carried with the remaining votes.
20-030-9012 – Madden – The HRA received verification of training completion. A motion to accept and close was entered by Shelia. The motion was seconded by Daryl and the motion carried with remaining votes.
20-030-9014 – Warren Barr South Loop – The HRA spoke about the case in regard to transfer timelines. There is no set statue defining when and how fast a patient should be transferred per request in nursing home facilities. The motion to accept and close was entered by Dallas. The motion was seconded by Daryl. The motion carried with the remaining votes.
20-030-9017 – Aspire Chicago – There was no response due or given. The motion to accept and close was entered by Shelia. The motion was seconded by Gary and the motion carried with the remaining votes.
