Illinois Guardianship and Advocacy Commission Human Rights Authority, Chicago Region met Aug. 9.

Here are the minutes provided by the commission:

Meeting Via WebEx

PRESENT: Marie Marasovich and Daryl Richardson.

ABSENT: Linda Cervenka, Gary Doherty, Jeff Gee, Jeremy Farmby, Alehae Khan and Dallas Read.

STAFF: Jeremy Polk (Disability Rights Manager)

GUEST: Sophia Pasko (citizen) and April Dear (UCP Seguin)

The regularly scheduled meeting of the Human Rights Authority, Chicago Region was called to order at 5:10 p.m. by the Chicago Region Member Daryl Richardson.

It was determined that a quorum was not present. The HRA did not move into close session. The confidentiality statement was read by Jeremy Polk.

Minutes: Minutes for June were not approved. The motion to table approval was entered by Daryl. The motion was seconded by Marie. The motion carried with remaining votes.

NEW BUSINESS

New Cases:

22-030-9035 – New Case – An eligible member reported that he was improperly admitted to a facility. He also indicated that the facility did not discharge him timely. The HRA voted to not accept the case as there was no release received. The motion to not accept was entered by Daryl. The motion was seconded by Marie. The motion will be ratified at the next meeting with a quorum.

22-030-9039 – New Case – A complainant states that they were not given a 5-day request for discharge when they asked for it. The report also states that the hospital provided inadequate care after continually complaining about hernias. For this issue complainant was encouraged to contact IDPH. The HRA voted to not accept the case as there was no release received. The motion to not accept was entered by Marie. The motion was seconded by Daryl. The motion will be ratified at the next meeting with a quorum.

22-030-9040 – Help at Home Inc – A complainant states that they were left without services for over 5 days. The complainant reports that the service agency did not make alternative arrangements pursuant to the service plan. Because of the lack of service options, the complainant experienced a decline in condition. The motion to accept was entered by Daryl. The motion was seconded by Marie. The motion will be ratified at the next meeting with a quorum.

23-030-9001 – New Case – A complainant states that they were begin held in a facility without merit after continually requesting discharge. The patient routinely asked for a 5-day request for discharge, but none was given. However, from conversations it was determined that the patient was not voluntary therefore unable to seek a 5-day. The motion to not accept was entered by Marie. The motion was seconded by Daryl. The motion will be ratified at the next meeting with a quorum.

23-030-9002 – Trilogy – A complainant states that they were subject to various forms of retaliation due to complaints filed against their service agency. The complainant stated one of the biggest issues is that there are not allowed to manage their own funds. The complainant reports that the facility holds their income and leaves them without money for long periods of time. The motion to accept was entered by Daryl. The motion was seconded by Marie. The motion will be ratified at the next meeting with a quorum.

23-030-9003 – New Case – A family member reports that a CILA home is refusing to allow two residents to visit with other family members. The DRM emailed the guardian and the facility. The DRM also had a lengthy conversation with the guardian, and it appears that the issue was handled. The motion to not accept was entered by Daryl. The motion was seconded by Marie. The motion will be ratified at the next meeting with a quorum.

23-030-9004 – Ascension Resurrection – A complainant states that they were not explained their rights and given forced medications without cause. They furthered that they were brought into the ED and remained calm until they wanted to leave. At that point the complainant was accosted by 4 male security guards and placed in restraints without need. The complainant then stated they complained of the restraints being too tight and suffered injuries. The motion to accept was entered by Daryl. The motion was seconded by Marie. The motion will be ratified at the next meeting with a quorum.

23-030-9005 – Ascension St. Joseph’s – A complainant states that they were not explained their rights and given forced medications without cause. The motion to accept was entered by Daryl. The motion was seconded by Marie. The motion will be ratified at the next meeting with a quorum.

23-030-9006 – New Case – A complainant states that they were not explained their rights and retaliated against for speaking up about their living conditions. The complainant was then evicted from the shelter. The DRM did not find a suitable agency to investigate the complains and was still researching. The HRA motioned to table acceptance. The motion was entered by Marie. The motion was seconded by Daryl. The motion will be ratified at the next meeting with a quorum.

23-030-9007 – New Case – A voluntary patient states that a facility injected him with medication without cause. The patient also stated that he was not being released timely. The DRM spoke with the complainant’s social worker who indicated that he just signed a 5-day release. The DRM also met with the Director of Psychiatry, and he indicated that a physician would see the patient shortly. The DRM left the facility and would follow up to see if the patient was discharged timely. The motion to table acceptance was entered by Marie. The motion was seconded by Daryl. The motion will be ratified at the next meeting with a quorum.

UNFINISHED BUSINESS

The HRA did not move into closed session pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2).

22-030-9015 – St. Mary’s – The HRA did not discuss this report as there was no quorum present. The motion to table acceptance was entered by Daryl. The motion was seconded by Marie. The motion will be ratified at the next meeting with a quorum.

Accept responses, close and publish:

21-030-9025 – Seguin – The HRA voted to close and publish this report with responses. The HRA added an addendum that represented that the facility was working with the guardian in good faith to return missing funds. The facility ultimately has encountered a road block as the guardian refused to assist in giving consent to speak with the IRS. The motion to accept and issue was entered by Daryl. The motion was seconded by Marie. The motion will be ratified at the next meeting with a quorum.

Other unfinished business, announcements and comments:

The HRA had a lengthy conversation with a community member attempting to present a complaint. The HRA provided the community member with information about the guardianship process – to which the community member seemed receptive but ultimately felt it was not in their best interest. The issue presented was not a mental health issue nor was it something that the HRA could assist with.
