The Illinois Gaming Board convened for a Regular Meeting at 9:00 A.M. On August 19, 2022, Governor JB Pritzker issued a statewide disaster proclamation in response to the COVID-19 Pandemic. Pursuant to Section 7(e) of the Open Meetings Act, the Board determined it was not practical or prudent, nor was it feasible, to hold an in-person meeting due to the ongoing COVID-19 pandemic. Therefore, the Board held the meeting through electronic means. The meeting was accessible on the morning of September 15, 2022, via livestream at: https://multimedia.illinois.gov/igb/igb-live.html.
A roll call was taken. The following Board members were present: Chairman Charles Schmadeke, Member Anthony Garcia, and Member Dionne Hayden. Three members of the Board being present, a quorum was satisfied.
At approximately 9:01 A.M., Member Garcia moved to go into closed session pursuant to Section 2(c), paragraphs (1), (11), (21) and (36) of the Open Meetings Act and Section 6(d) of the Illinois Gambling Act to discuss items on the closed session agenda relating to the employment and performance of a specific employee, pending litigation, the review of closed session minutes of the Regular Board Meetings, and to deliberate on decisions of the Illinois Gaming Board in which there is discussed personal, commercial, financial, or other information obtained from any source that is privileged, proprietary, confidential, or a trade secret; or information specifically exempted from the disclosure by federal or State law. Member Hayden seconded the motion. The Board approved the motion unanimously by voice vote. Thereafter, the Board held its closed session meeting through electronic means, the minutes of which are separately recorded. The Board’s closed session meeting was not accessible via livestream at https://multimedia.illinois.gov/igb/igb-live.html.
At approximately 10:00 A.M., the Board reconvened its Regular Meeting of Thursday, September 15, 2022, pursuant to the Illinois Open Meetings Act, 5 ILCS 120/1 et seq. Another roll call was taken. The following Board members were present: Chairman Charles Schmadeke, Member Anthony Garcia, and Member Dionne Hayden. Three members of the Board being present, a quorum was satisfied.
APPROVAL OF OPEN SESSION MINUTES
The Board voted unanimously to approve the open session minutes from its Regular Meeting held on July 28, 2022.

ADMINISTRATOR’S REPORT
Administrator Fruchter began his comments by noting that September is responsible gaming education month. He noted that the topic is important to the IGB and all gaming stakeholders and that the IGB is committed to this endeavor on a year-round basis.
The Administrator provided an update on the status of the casino to be located in Chicago. He noted that the application was submitted to the IGB in August and IGB staff is in the process of reviewing the application materials.
The Administrator mentioned that it has been 10 years since the first VGT became operational in Illinois. At present, Illinois’ distributed gaming market is the largest in the world and continues to evolve and grow. Administrator Fruchter indicated the IGB would continue to engage with its partners to ensure that the industry enjoys future success and experiences improvements.
Administrator Fruchter reminded the audience that the sales agent licensing rule was published for first notice in the Illinois Register on February 2, 2022. He invited all stakeholders to comment on this important rule proposal by October 21, 2002. The Administrator noted that the Joint Committee on Administrative Rules (“JCAR”) recently approved the amendment to Rule 320. The further noted that the updated Rule 320, which impacts Use Agreements, becomes effective on October 1, 2022.
The Administrator noted that there are currently 8,076 Licensed Establishments operating an aggregate of 43,938 VGTs. In addition, there are 5,182 Establishments operating more than 5 VGTs. In July, VGTs generated Net Terminal Income (“NTI”) of $225,823,365, which yielded a total tax of $76,774,436. The State received $65,484,080 and municipalities received $11,290,355. In August, VGTs generated NTI of $226,949,470, yielding a total tax of $77,163,169. The State received $65,819,577, while locals earned $11,343,591. In July, Illinois’ casinos had Adjusted Gross Receipts (“AGR”) of $122,866,218, generating a State tax of $29,687,218 and a local tax of $6,985,185. In August, Illinois’ casinos had AGR of $117,326,539, generating a State tax of $29,417,448 and a local tax of $6,657,306. In July, sports wagering generated AGR of $46,080,136, yielding a State tax of $6,912,020 and a Cook County tax of $480,897.

The Board entertained comments from Thomas A. Thanas, Executive Director of the Illinois Casino Gaming Association.
ADMINISTRATIVE MATTERS
The Board voted unanimously to approve the dissemination of the minutes of the closed sessions held by the Board on February 4, 2021; March 10, 2021; April 21, 2021; July 14, 2021; September 9, 2021; October 13, 2021; October 20, 2021; October 28, 2021; November 18, 2021 and December 8, 2021 as those minutes no longer require confidential treatment.
