Illinois Educational Labor Relations Board met April 19.

Here are the minutes provided by the board:

I. PRESENT

Chairman Lara Shayne (Chicago); Board Member Michelle Ishmael (Springfield); Board Member Steve Grossman (Chicago); Board Member Chad Hays (Springfield); Executive Director Victor Blackwell (Chicago); General Counsel Ellen Strizak (Chicago); Assistant General Counsel Dawn Harden (Chicago); Staff Attorney Nick Gutierrez (Webex); Staff Member Meredith Dean (Springfield).

II. OPENING STATEMENT AND BOARD MEMBER ATTENDANCE

Chairman Shayne made a statement regarding the meeting venue then took attendance. All Board Members present.

III. APPROVAL OF OPEN MINUTES OF BOARD MEETING HELD March 8, 2023

Chairman Shayne called for a motion to approve the open minutes from the March 8, 2023, Board Meeting. Board Member Hays so moved to approve the open minutes of the March 8, 2023, Board meeting. Board Member Grossman seconded. The Board passed the motion unanimously by roll call vote.

IV. REVIEW OF CLOSED SESSION MINUTES

Chairman Shayne called for a motion to make the closed session minutes from the June 15, 2022, July 20, 2022, September 21, 2022, February 22, 2023, and March 8, 2023 meetings open. Board Member Ishmael so moved. Board Member Hays seconded. The Board passed the motion unanimously by roll call vote.

V. CASES

Esposito-Usterbowski, et al./Chicago Teachers Union, Case No. 2023-CB-0011-C (Injunctive Relief Request)

Chairman Shayne stated that the case was placed on the agenda because the unfair labor practice charge included a request for injunctive relief. She indicated that because the Board’s Executive Director had dismissed the charge instead of issuing a Complaint and Notice of Hearing, the Board would not discuss the case at the meeting.

Kugler/Chicago Teachers Union, Case No. 2022-CB-0005-C

Chairman Shayne called the case. The case is before the Board on exceptions to an Executive Director’s Recommended Decision and Order. General Counsel Strizak presented a memo on the case and recommended that the Board affirm the Executive Director’s decision to dismiss the charge. Chairman Shayne directed the General Counsel to draft an opinion and order consistent with her memo.

VI. FINAL ORDER CASES

Evanston Community Consolidated School District 65/Evanston Association of Child Care Professionals, IEA-NEA and District 65 Educational Secretarial and Clerical Association, IEA-NEA, Case No. 2023-UC-0016-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Dawn Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Grossman so moved, and Board Member Ishmael seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Rantoul City School District No. 137/Rantoul City Education Support Professionals Association, IEA-NEA, Case No. 2023-UC-0017-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Dawn Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Hays so moved, and Board Member Grossman seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Mokena School District 159/Mokena Classified Staff Association, IEA-NEA, Case No. 2023-UC-0020-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Dawn Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Ishmael so moved, and Board Member Grossman seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Pekin Community High School District 303/Pekin Teachers’ Alliance, IEA-NEA, Case No. 2023-AC-0004-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Dawn Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Ishmael so moved, and Board Member Hays seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

VIII. BUDGET/FISCAL

Staff Member Meredith Dean presented FY23 budget and fiscal information.

IX. CASE STATUS REPORT

Executive Director Victor Blackwell presented information from the case status report.

X. STRIKE REPORT UPDATE

Executive Director Blackwell presented current strike activity.

XI. LEGISLATIVE UPDATE

Staff Attorney Gutierrez advised the Board on HB297.

XII. LITIGATION UPDATE

General Counsel Strizak advised the Board on first district appellate court cases.

XIII. ADDITION TO MEDIATION-ARBITRATION ROSTER: RICHARD BALES

Chairman Shayne called for a motion to add Richard Bales to the roster. Board Member Grossman so moved and Board Member Hays seconded. The Board passed the motion unanimously by roll call vote.

XIV. AGENCY OPERATIONS

Executive Director Blackwell advised the Board concerning ethics filing deadlines. Additionally, discussions regarding the advisory council meeting and ethics training in Springfield ensued.

XV. ADJOURN

The Board did not go into closed session. Chairman Shayne called for a motion to adjourn the meeting. Board Member Ishmael so moved, and Board Member Hays seconded the motion. The Board voted unanimously by roll call vote to adjourn the meeting and the motion passed.
