Earlier today, the 7th Circuit Court of Appeals extended the stay on Judge McGlynn’s decision that declared the Illinois Gun Ban unconstitutional. This means the ban will remain in effect until the court hears the case.
The Illinois State Rifle Association (ISRA) expressed mixed feelings about this development. They stated, "While we are glad that Federal District Court Judge Stephen McGlynn’s stay would have expired on Sunday, December 8th, we are disappointed – but not surprised – that the Seventh Circuit Court of Appeals has extended that stay." The ISRA had previously achieved a victory when Judge McGlynn found provisions of the Illinois ban on firearms and accessories known as “PICA” to be unconstitutional.
The State of Illinois appealed immediately after Judge McGlynn's ruling, leading to this ongoing legal battle. The ISRA remains committed to challenging the law, stating, "When this unconstitutional bill was signed by Gov. Pritzker in January 2023, we promised to see the State of Illinois in Court – and we’ve held firm on that promise – and we won’t back down until our 2nd Amendment rights are restored in Illinois."
