Illinois Gaming Board Met Jan. 27.

The Illinois Gaming Board (“Board”) convened for a Regular Meeting at approximately 10:00 A.M. In accordance with Section 12 of the January 8, 2021 Disaster Proclamation issued by Governor JB Pritzker, in-person attendance of more than fifty people at the regular meeting location was not feasible; therefore the Board held the meeting through electronic means. The meeting was accessible on the morning of January 27, 2021 via livestream at: https://multimedia.illinois.gov/igb/igb-live.html.
A roll call was taken. The following Board members were present: Chairman Charles
Schmadeke, Member Anthony Garcia, Member Dionne Hayden and Member Ruben Ramirez. Four members of the Board being present, a quorum was satisfied.
APPROVAL OF OPEN SESSION MINUTES
The Board unanimously approved the open session minutes from its Regular Meeting held on Thursday,December 17, 2020.
CHAIRMAN’S COMMENTS
Chairman Schmadeke welcomed everyone to the first Board meeting of 2021 and urged location establishments to continue to practice safety measures to help prevent the spread of the COVID virus.
ADMINISTRATOR’S REPORT
Administrator Fruchter began his report by echoing the comments made by the Chairman and reminding everyone to remain vigilant during the COVID pandemic by complying with the existing COVID protocols and mitigation measures in place to help limit the spread of the virus. The Administrator then made several comments about November sports wagering data and explained the relevant sports wagering rules regarding permissible bets. With respect to the video gaming industry, Administrator Fruchter announced that there are currently 37,796 video gaming terminals in operation at 7,439 licensed locations. The Administrator also discussed the concerns about inducements in the video gaming industry and the process which led to proposed Board Rule 350 on inducements. He also commented about the maximum length of term for a use agreement as defined by Rule 320(a)(8). Finally, Administrator Fruchter noted that the IGB continues its work in all phases of Illinois’ gaming industry including the new casino Owners license applications.
PUBLIC COMMENTARY
The Board entertained comments from Anita Bedell, Illinois Church Action on Alcohol and AddictionProblems.
ADMINISTRATIVE MATTERS
• Dissemination of Closed Session Minutes (January 2020)
The Board voted unanimously to adopt the staff’s recommendation to approve the dissemination of the minutes of the closed session held by the Board on January 30, 2020.
• Delegation of Authority to Administrator – Rule 340(a)
The Board voted unanimously to adopt the staff’s recommendation to amend the June 11, 2020
Resolution to include the authority to grant requests under Rule 340(a).
CASINO
The Board entertained a presentation by Owners licensee applicant, 815 Entertainment, LLC d/b/a Hard Rock Casino Rockford regarding its preliminary suitability for licensure.
Request to Amend Owners License Application
• Full House Resorts, Inc. d/b/a American Place
The Board voted unanimously to adopt the staff’s recommendation to grant Full House Resorts, Inc.= d/b/a American Place’s request to amend its Owners license application.
OCCUPATIONAL LICENSEE ITEMS
Level 2 and Level 3 License Applications – Approvals and Denials:
The Board voted unanimously to adopt the staff’s recommendation to approve 7 Level 2 and 5 Level 3 occupational license applicants.
Occupational License Renewals by the Administrator
Pursuant to the authority delegated by the Board on June 11, 2020, the Administrator renewed the Level 1, 2, and 3 licenses of individuals who were licensed or renewed in January 2020 and who have properly updated their applications and complied with the requirements of the Illinois Gambling Act and the Board’s Rules.

SPORTS WAGERING OCCUPATIONAL LICENSEE ITEMS
Level 1 License Applications
The Board voted unanimously to approve David Eric Schmidt as a Sports Wagering Level 1 Occupational Licensee as it relates to sports wagering operations at Grand Victoria Casino.
Level 2 and Level 3 License Applications – Approvals
The Board voted unanimously to adopt the staff’s recommendation to approve the Level 2 sports wagering occupational licenses of 14 individual applicants.VIDEO GAMING

Initial Licenses – Approval and Denials
The Board voted unanimously to adopt the staff’s recommendation to approve 17 Terminal Handler licenses and 2 Technician licenses for a period of one year, expiring in January 2022, subject to licensee’s payment of the applicable licensing fee on or before February 28, 2021.
VG Technicians and Terminal Handler License Renewals
Pursuant to the authority delegated by the Board on June 11, 2020, the Administrator renewed the licenses of Technicians and Terminal Handlers who were licensed or renewed in January 2020, and who have properly updated their applications and complied with the requirements of the Video Gaming Act and the Board’s Rules.

The Board voted unanimously to adopt the staff’s recommendation to deny the renewal of DESPERADO BAR AND GRILL LLC.
The Board voted unanimously to adopt the staff’s recommendation to deny the renewal of JEXAL’S INC. d/b/a JEXAL’S WINGZERIA.REQUESTS FOR HEARING
The Board voted unanimously to adopt the staff’s recommendation to deny Hiram Lewis d/b/a Hiram’s request for hearing.
The Board voted unanimously to adopt the staff’s recommendation to deny N.K.N., Incorporated d/b/a Kozy Nook Restaurant’s request for hearing.
The Board voted unanimously to adopt the staff’s recommendation to rescind the September 2020 denial of Twisted Spoke Saloon Corporation d/b/a Twisted Spoke Saloon, grant it a Video Gaming Location Establishment license, and deny the request for hearing as moot.
LITIGATION/SETTLEMENTS
The Board voted unanimously to adopt the staff’s recommendation to adopt the Administrative Law Judge’s recommendation to enter a default judgment against Michael Wayne Figueroa, case number 20 GB 013.
ADJOURN
The Board voted unanimously to move into a closed session meeting pursuant to Section 2(c)(11) of the Open Meetings Act for the purpose of discussing pending litigation and Section 2(c)(36) of the Open Meetings Act and Section 6(d) of the Illinois Gambling Act for the purpose of discussing personal, commercial, financial or other information that is privileged, proprietary, confidential, or a trade secret related to the preliminary suitability of Owners License applicant 815 Entertainment, LLC under Rule230(c) with such meeting to be held by electronic means on February 4, 2021 at 9:30 AM.
The Board voted unanimously to adjourn the January 27, 2021 meeting.
