Illinois Guardianship and Advocacy Commission Human Rights Authority, Springfield Region met Sept. 28.

Here are the minutes provided by the commission:

PRESENT: Tara Dunning, Javed Irshad, Janet Shelton, James Bakunas and Abdush Shakoor.

ABSENT/EXCUSED: Diana Braun and Lisa Beam

STAFF: Jon Burnet Guests: Karen Osgood

The regularly scheduled meeting of the Human Rights Authority, Springfield Region was called to order at 5:36 p.m. by the Springfield Region Chair, Tara Dunning.

It was determined that a quorum was present and that appropriate business could be conducted. Janet read the confidentiality statement.

Minutes: Janet moved to accept the June 29, 2021 open and closed session minutes with one correction and the August 10, 2021 open session minutes with one correction. Jay seconded and the motion carried.

Communications:

Welcome back Shakoor, and welcome prospective new member, Karen Osgood.

NEW BUSINESS

Ratifications for case acceptance:

22-050-9002 (IAG) Opened August 10, 2021. A resident was petitioned for an involuntary psychiatric admission based on false information. Janet moved to ratify opening the case for investigation. James seconded and the motion carried.

22-050-9004 (McFarland MHC) Opened August 10, 2021. A patient’s designated support person is prohibited from attending treatment team meetings. Janet moved to ratify opening the case for investigation. James seconded and the motion carried.

22-050-9005 (Pathway Services) Emergency opened August 31, 2021. A CILA has over restrictive house rules. Janet moved to ratify opening the case for investigation. James seconded and the motion carried.

Ratifications for case non-acceptance:

21-050-9009 Not accepted August 10, 2021. Police used excessive force with a mentally ill citizen. The case is still in court. Janet moved to ratify no acceptance of the case for investigation. James seconded and the motion carried.

22-050-9001 Not accepted August 10, 2021. A hospital relied on an incompetent patient’s signature to release information. A release was not returned from the guardian. Janet moved to ratify non acceptance of the case for investigation. James seconded and the motion carried.

22-050-9003 Not accepted August 10, 2021. A CILA will not allow vaccinated residents to dine out. The HRA did not accept based on new surge in positive cases. Janet moved to ratify non acceptance of the case for investigation. James seconded and the motion carried.

Ratifications for report approval/issuance:

21-050-9008 (McFarland MHC) Accepted/issued August 10, 2021. Janet moved to ratify acceptance/issuance of the report. James seconded and the motion carried.

Ratifications for case closures:

21-050-9003 (Bethesda Lutheran) Response not required. Closes/published August 10, 2021. Janet moved to ratify to close the case and publish. James seconded and the motion carried.

21-050-9005 (McFarland MHC) Response received but not required. Accepted/closed/published August 10, 2021. Janet moved to ratify response acceptance, case closure and publish. James seconded and the motion carried.

UNFINISHED BUSINESS

At 6:00 p.m., James moved to enter the executive/closed session pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2). Jay seconded and the motion carried. The purpose of the closed session was for discussion on any case assignments, case progress, draft reports, responses and case closures (21-050-9007, 9008 and 9010; 22-9002, 9004 and 9005.). The HRA returned to open session at 6:38 p.m., having taken no votes in the closed session.

Case progress:

21-050-9007 (Blessing Hospital) Interviews were held on August 26 and discussed.

21-050-9010 (McFarland MHC) Interviews were held on September 7 and discussed.

22-050-9004 (McFarland MHC) Interviews were held on September 7 and discussed.

Reports for acceptance:

21-050-9007 (Blessing Hospital) The report was reviewed and there were no changes. James moved to accept the report and issue. Janet seconded and the motion carried.

21-050-9010 (McFarland MHC) The report was reviewed and there were no changes. James moved to accept the report and issue. Janet seconded and the motion carried.

Accept responses, close and publish:

21-050-9008 (McFarland MHC) A response was received although not required. Janet moved to accept the response, close and publish the case. Shakoor seconded and the motion carried.

Other unfinished business, announcements and comments:

Janet we’ll miss you and hope to see you again after your year off.

The next meeting is October 26, 2021. The HRA will meet in person again.
