Illinois Guardianship and Advocacy Commission Human Rights Authority, Chicago Region met Oct. 19.

The regularly scheduled meeting of the Human Rights Authority, Chicago Region was called to order at 5:08 p.m. by the Chicago Region Member Gary Doherty.
It was determined that a quorum was not present, however the HRA did conduct some regular business. The HRA also did not advance into closed session. The confidentiality statement was read by Jeremy Polk.
Minutes: Minutes for July and September were tabled until the next meeting with a quorum. The motion to table was entered by Gary. The motion was seconded by Dallas.
Communications: A potential member joined and participated in the open session of the meeting.
NEW BUSINESS
Ratifications:
22-030-9006 – Madden – A complainant reports being sexually assaulted and given forced medication during a psychiatric stay in the state facility. The complainant informed the DRM that she was a voluntary patient at the facility and one night while resting a male patient came into her room at night and made unwanted sexual advances. The complainant stated she was kissed and that she ran and pulled a fire alarm because of the assault. The complainant then stated the facility did nothing and gave her forced medications. The DRM forwarded the abuse information to OIG. The ratification was tabled due to not having a quorum. The motion was entered by Gary, the motion was seconded by Daryl. The motion to open will be ratified at the next meeting with a quorum.
20-030-9022 – C4 – The HRA discussed this report. The facility disagreed with the HRA’s explanation of violation but did agree with the HRA’s recommendations. The facility indicated they instituted new policy around treatment planning and updating the information. The ratification was tabled due to not having a quorum. The motion was entered by Gary, the motion was seconded by Daryl. The motion to accept response and publish will be ratified at the next meeting with a quorum.
21-030-9017 – Southview – The facility did not provide a response, nor was one necessary. The HRA voted to close and publish this case. The ratification was tabled due to not having a quorum. The motion was entered by Gary, the motion was seconded by Daryl. The motion to close and publish will be ratified at the next meeting with a quorum.
New Cases:
22-030-9007 – Rush Oak Park Hospital – A family member reports that an elderly disabled person was subject to inhumane treatment at Rush Hospital in Oak Park. The chief complainant is that hospital failed to safely handle the patient and did not honor the rights of the power of attorney. Motion to open and address informally was entered by Gary. The motion was seconded by Daryl. This motion will be ratified at the next meeting with a quorum.
22-030-9008 – New Case – An eligible person sites inhumane treatment from a federal hospital. The Disability Rights Manager met with the complainant in the hospital and referred this case out to the Federal Inspector General. The motion to not accept was entered by Daryl. The motion was seconded by Gary. The motion will be ratified at the next meeting with a quorum.
22-030-9009 – Trilogy – A guardian reported that a service agency is not allowing him to participate in the treatment plan. The guardian also indicates that the service agency is not consulting him on various decision regarding his ward. The guardian furthers that he also does not receive notification of pertinent information. The motion to accept was entered by Daryl. The motion was seconded by Gary. The motion will be ratified at the next meeting with a quorum.
22-030-9010 – Central Plaza – A guardian reported that a nursing home was not provided requested medical records at her request. The motion to open informally was entered by Gary. The motion was seconded by Daryl. The motion will be ratified at the next meeting with a quorum.
UNFINISHED BUSINESS
The HRA did not move into closed session pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2).

20-030-9020 – Northwestern – The HRA discussed this report in open session maintaining all confidentiality mandates. The hospital’s asked for more time in updating all policies and providing training. The response is due November 23, 2021. Motion to table acceptance was entered by Daryl. The motion was seconded by Dallas. The motion carried and will be ratified at the next meeting with a quorum.
22-030-9004 – St. Bernard – The HRA discussed this case. Notice was provided from the facility that the issue was previously investigated by equip for equality. The facility provided the investigation notes and summary. The facility also provided the requested record. The HRA moved to close this case. The motion was entered by Gary. The motion was seconded by Daryl. The motion will be ratified at the next meeting with a quorum.
