Illinois Guardianship and Advocacy Commission Human Rights Authority, Springfield Region met March 29.

Here are the minutes provided by the commission:

PRESENT: Tara Dunning, Javed Irshad, Abdush Shakoor, Lisa Beam, Diana Braun, James Bakunas and Karen Osgood.

The regularly scheduled meeting of the Human Rights Authority, Springfield Region was called to order at 5:33 p.m. by the Springfield Region Chair, Tara Dunning.

It was determined that a quorum was present and that business could be conducted. James read the confidentiality statement.

Minutes: Lisa moved to approve the February 22, 2022 open and closed session minutes. Jay seconded and the motion carried.

New complaints:

22-050-9011 An area police department has had a few incidents of taking patients to the ED for evaluation, completing petitions and the hospital refuses to proceed with mental health evaluations; tore up a petition and would not provide copies to the officer in one instance. Alleging violation of right to mental health treatment. HRA tabled pending police interviews. Jon conducted interviews and retrieved police reports and statements from police verifying incidents. Diana moved to accept the complaint for investigation. Shakoor seconded and the motion carried.

22-050-9012 A CILA resident alleges that he has not been given his weekly spending money in three to four weeks. He did not know why. HRA tabled pending more info from the guardian on reasons why no money access. Jon followed up with guardian who reported all was well at this time. Karen moved to not accept the complaint for investigation. James seconded and the motion carried.

22-050-9013 A hospital patient was given emergency injections and restrained for no adequate reasons. Lisa moved to accept the complaint for investigation. Diana seconded and the motion carried.

UNFINISHED BUSINESS

At 5:56 p.m., James moved to enter the executive/closed session pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2). Shakoor seconded and the motion carried. The purpose of the closed session was for discussion on any case assignments, case progress, draft reports, responses and case closures (22-050-9002, 9006 and 9009). The HRA returned to open session at 6:06 p.m., having taken no votes in the closed session.

Case progress:

22-050-9006 (McFarland MHC) Shakoor and Jon interviewed the staff involved with the alleged incident. They reported to the HRA on their findings and a draft report is prepared for review.

Reports for acceptance:

22-050-9006 (McFarland MHC) The HRA reviewed the report and added a suggestion regarding the definition of humane care. Lisa moved to accept and issue the report with the added suggestion. Diana seconded and the motion carried.

22-050-9009 (Aperion Care) The report was reviewed, and no changes were made. James moved to accept and issue the report as drafted. Shakoor seconded and the motion carried.

Accept responses, close and publish:

22-050-9002 (IAG) A response was not required. James moved to close and publish the case. Karen seconded and the motion carried.
