Illinois Guardianship and Advocacy Commission Human Rights Authority, Chicago Region met May 17.

Here are the minutes provided by the commission:

PRESENT: Linda Cervenka, Gary Doherty, Jeff Gee, Marie Marasovich, Dallas Read and Daryl Richardson.

ABSENT: Jeremy Farmby, Shelia Orr, Alehae Khan.

STAFF: Jeremy Polk (Disability Rights Manager)

GUEST: Rachael Wilson (Cook County)

The regularly scheduled meeting of the Human Rights Authority, Chicago Region was called to order at 5:03 p.m. by the Chicago Region Member Gary Doherty.

It was determined that a quorum was present. However, the HRA did not move into close session. The confidentiality statement was read by Jeremy Polk.

Minutes: Minutes for April were approved. The motion to approve was entered by Gary. The motion was seconded by Dallas. The motion carried with remaining votes.

Communications:

The HRA briefly spoke about the Governor Pandemic Meeting Exemptions expiring and a return to in person meeting.

NEW BUSINESS

New Cases: 

22-030-9026 – New Case – A complainant reports being subjected to verbal and emotional abuse. The complainant also reported never being included in the treatment planning process consistently. The abuse complaint was forwarded to OIG on April 12, 2022. The HRA motioned to table this case pending response from OIG. Motion to table was entered by Gary. The motion was seconded by Marie. The motion carried with remaining votes.

22-030-9027 – New City Supportive Living – Complainant reports that a facility lost his items and is not helping him secure alternative housing pursuant to the service plan. The motion to accept was entered by Gary. The motion was seconded by Linda. The motion carried with remaining votes.

22-030-9028 – Thresholds – A complainant reports being improperly subject to verbal and emotional abuse. Complainant also reported never being included in treatment planning consistently. Complainant reports that the facility retaliated against her for complaining about them not visiting. The motion to accept was entered by Linda. The motion was seconded by Gary and the motion carried with remaining votes.

22-030-9029 – Swedish Covenant Hospital – Complainant states she was given forced medications without cause and reported having her personal items taken away from her for no reason. Motion to accept was entered by Gary. The motion was seconded by Jeff and the motion carried with remaining votes.

22-030-9030 – Lutheran Social Services – A guardian reported that a facility is retaliating against a ward due to filing a complaint. The guardian also reports that they were never consistently included in the treatment plan. The motion to accept the case was entered by Gary. The motion was seconded by Linda. The motion carried with remaining votes.

22-030-9031 – New Case – A family member reported that a loved one was taken to the hospital and later sent out for psych care. Once at facility it was reported that the patient was improperly admitted. Family also reports that facility’s staff was uncooperative with sharing information and did not discharge patient timely. The HRA tabled due to not having a signed release. Motion to table was entered by Jeff. The motion was seconded by Gary. The motion carried with remaining votes.

22-030-9032 – New Case – An eligible member reported that he was improperly admitted. He also stated that he received forced medication for continually requesting a N95 masked. Finally, he stated that the facility did not discharge him timely. The HRA tabled due to not having a signed release. Motion to table was entered by Jeff. The motion was seconded by Linda. The motion carried with remaining votes.

22-030-9033 – Cook County Jail – A recipient of service indicates that while incarcerated he is not receiving proper medications, meals and being treated inhumanely. The report furthered that the recipient is required to receive seizure medication twice daily but does not. Motion to accept was entered by Gary. The motion was accepted by Linda. The motion carried with remaining votes.

UNFINISHED BUSINESS

The HRA did not move into closed session pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2).

21-030-9008 – Riveredge – The HRA voted to table closure of this case as the USPS did not deliver the response notification to the facility in ample time. The motion to table was entered by Gary. The motion was seconded by Daryl. The motion carried with remaining votes.

21-030-9025 – Seguin – The HRA voted to table closure of this case as the USPS did not deliver the response notification to the facility in ample time. The motion to table was entered by Gary. The motion was seconded by Daryl. The motion carried with remaining votes.

22-030-9011 – Thresholds – The facility did not provide a response to this case. The HRA motioned to close and publish this report. The motion was entered by Gary. The motion was seconded by Daryl. The motion carried with remaining votes.

22-030-9012 – ALBOH – The HRA moved to close this informal case. The complainant did not receive any mental health services from the facility. The motion to close was entered by Jeff. The motion was seconded by Gary. The motion carried with remaining votes.
