Illinois Guardianship and Advocacy Commission Human Rights Authority - Northwest Region met July 12.

Here are the minutes provided by the commission:

PRESENT: Colleen Magee (Co-Chair), Ruth Robinson, Kacie Terranova (Chair), Dr. Wade and Brett Williams (V) 

ABSENT: Sang Capone

STAFF: Nicole S. Weathersby, DRM (I) 

GUESTS: Aimee LeBlanc - Hodges, Loizzi, Eisenhammer, Rodick & Kohn(I)

The regularly scheduled meeting of the Human Rights Authority - Northwest Region was called to order at 4:03pm by the Chair - Kacie Terranova. Introductions and greetings were completed during the sign-in period of the meeting. A moment of silence was taken for the recent loss of HRA Member (David C.). A quorum was determined to be present after roll call of members via Hybrid (WebEx & In-Person) and appropriate business could be finalized. DRM read the confidentiality statement.

Minutes: Executive and regular meeting minutes from June 7, 2022, were reviewed and moved for approval with correction of changing the signature line by Brett W., seconded by Colleen M., and motion carried unanimously by HRA members present.

NEW BUSINESS 

Agenda Updates/Changes: 

Addition/Changes to the agenda were the following items:

a. New complaint 22-080-9016 (already in meeting packet)

Colleen M., moved to add the changes and accept the agenda, seconded by Ruth R., and motion carried unanimously by HRA members present.

Ratifications for Case Referral and Acceptance: 

22-080-9013 – Tabled from the last HRA meeting until receipt of a signed consent and at this time a signed consent has been received. Dr. Wade moved to accept and open complaint, the motion was seconded by Brett W. and the motion carried unanimously by HRA members present roll call.

22-080-9014 – Tabled from the last HRA meeting until receipt of a signed consent and at this time a signed consent has been received. Dr. Wade moved to accept and open complaint, the motion was seconded by Brett W. and the motion carried unanimously by HRA members present roll call.

New Complaint:  

23-080-9001 – The complainant stated while hospitalized was forcibly given a shot of Haldol and inappropriately restrained. Complainant also stated while hospitalized, their medical records and doctor interactions were falsified in the nursing notes. The complainant stated their request to see a medical doctor was not honored or addressed.

Colleen moved to accept and open complaint and the motion was accepted by Dr. Wade and carried via unanimously roll call of HRA members present.

Comments from the Public: 

Introduction of visitor – Aimee LeBlanc of Hodges, Loizzi, Eisenhammer, Rodick & Kohn.

UNFINISHED BUSINESS  

Closed Session  

Pursuant to the Guardianship and Advocacy Act (20 ILCS 3955/21) and the Open Meetings Act (5 ILCS 120/2), Brett W., motioned to enter close session at 4:14pm and seconded by Dr. Wade and carried unanimously by HRA members present roll call. The purpose of the closed session is to discuss any case assignments, case progress, case closures, report discussion and responses (21-080-9001, 21-080-9003, 21-080-9012, 21- 080-9014, 22-080-9001, 22-080-9004, 22-080-9011, 22-080-9013, 22-080-9014, 23-080- 9001). The HRA returned to open session at 5:23pm, via motion by Ruth R., seconded by Brett W., and carried via unanimously roll call of HRA members present.

Case Progress  

Draft Reports for Acceptance: 

21-080-9012 (DeKalb School District) HRA Committee voted to accept draft report and send to facility for a response within 30 days, moved by Brett W., seconded by Colleen M., and motion carried via unanimously roll call of HRA members present.

21-080-9014 (UWHealth/SwedishAmerican Hospital) – HRA Committee voted to revisit the recommendations section with stronger language and resubmit to committee for approval and then send out for a response to facility moved accept draft report and send to facility for a response within 30 days, , moved by Brett W., seconded by Colleen M., and motion carried via unanimously roll call of HRA members present.

22-080-9001(UWHealth/SwedishAmerican Hospital) – HRA Committee voted to table draft report, pending Director’s review and will revisit and review at the next scheduled HRA meeting, moved by Brett W., seconded by Dr. Wade and motion carried via unanimously roll call of HRA members present.

Accept Responses, Close and Publish Report: 

21-080-9001(Florence Nursing Home and Rehab) – HRA Committee voted to publish the non-substantiated report, response not needed, post on agency website and close the case, moved by Dr. Wade and seconded by Colleen M., and motion carried via unanimously roll call of HRA members present.

21-080-9003(UWHealth/SwedishAmerican Hospital) – HRA Committee voted to publish the non-substantiated report, response not needed, post on agency website and close the case, moved by Dr. Wade and seconded by Colleen M., and motion carried via unanimously roll call of HRA members present.

Other Unfinished Business, Announcements and Comments 

Discussed the purchase of a remembrance tree for HRA Member ( Dave C.) that passed away. DRM will let everyone know the location once the tree is planted. Also reminded everyone of the upcoming memorial service and shared the arrangements.

Discussed needing to fulfill the Secretary position ( due to recent death of member) and recruitment of new members is needed.

DRM announced all NW HRA Members have completed the annual sexual harassment and ethics training certificates before the deadline of July 1, 2022. Great job team.

Brett W., moved to adjourn the meeting at 5:37pm, seconded by Dr. Wade and motion carried unanimously by HRA members present.

The next meeting will be held on Tuesday, August 30, 2022, at the office of the Illinois Guardianship and Advocacy Commission, 4302 N. Main St., Conference Room - Rockford, IL at 4:00pm.
