Illinois Guardianship and Advocacy Commission Egyptian Regional Human Rights Authority met Sept. 15.

Here are the minutes provided by the commission:

The regular meeting of the Human Rights Authority (HRA) was held at Pagliai’s Pizza (Meeting Room), 509 S. Illinois. Ave, Carbondale, IL. The meeting was called to order at 5:23 p.m. Chairperson, Paul Jones, read the confidentiality statement. A quorum was present.

Members Present: Clarence Russell, Kathy Rambeau, Rebecca Lewey, Blair Anderson & Paul Jones

Members Absent: Alma DeWitt & Beverly Warshawsky

Staff Present: Kim Conway

Guests: None

Minutes: Meeting minutes for May & July were reviewed and no changes were made. Blair Anderson made a motion to approve the minutes for both months, Clarence Russell seconded, and it carried.

Communications: Kim Conway shared that there are currently two board vacancies for citizen members. Kim also notified board members of new trainings which need to be completed annually for Diversity and Inclusion and Security Awareness. 2022 trainings need to be completed by November 30th. Kim also shared some recent court rulings involving Chester Mental Health.

Other New Business: None

Ratifications: The following actions taken at the July meeting were ratified as follows at the September meeting when a quorum was present:

Emergency Case Openings:

1. 23-110-9001 – Chester Mental Health - Kathy Rambeau made a motion to ratify emergency case opening. Clarence Russell seconded, and it carried.

2. 23-110-9002 – Chester Mental Health - Blair Anderson made a motion to ratify emergency case opening. Kathy Rambeau seconded, and it carried.

3. 23-110-9003 – State Operated Developmental Center – Clarence Russell made a motion to ratify tabling case opening for outcome of dental appointment. Blair Anderson seconded, and it carried.

4. 23-110-9004 – Housing Authority – Kathy Rambeau made a motion to ratify tabling case opening to allow time for a release of information to be received. Rebecca Lewey seconded, and it carried.

5. 23-110-9005 – Community Mental Health Unit – Rebecca Lewey made a motion to ratify tabling case opening to allow time for a release of information to be received. Kathy Rambeau seconded, and it carried.

Draft Reports:

1. 21-110-9002 – Choate Mental Health – Blair Anderson made a motion to ratify approving the draft report as stated and send to provider. Kathy Rambeau seconded, and it carried.

2. 21-110-9010 – Progressive Housing – Clarence Russell made a motion to ratify approving the draft report as stated and send to provider. Blair Anderson seconded, and it carried.

3. 22-110-9012 – Choate Developmental Center – Kathy Rambeau made a motion to ratify approving the draft report as stated and send to provider. Rebecca Lewey seconded, and it carried

4. 22-110-9013 – Choate Developmental Center – Clarence Russell made a motion to ratify approving the draft report as stated and send to provider. Blair Anderson seconded, and it carried.

Closures:

1. 19-110-9015 – Choate Developmental Center – Kathy Rambeau made a motion to ratify closing the case and making the report public. Clarence Russell seconded, and it carried.

2. 20-110-9003 – Chester Mental Health - Kathy Rambeau made a motion to ratify tabling case closure to continue negotiations. Blair Anderson seconded, and it carried.

3. 20-110-9011 – Chester Mental Health – Clarence Russell made a motion to ratify tabling case closure for outcome of dental appointment. Rebecca Lewey seconded, and it carried.

4. 22-110-9001 – Choate Mental Health – Kathy Rambeau made a motion to ratify tabling case closure for outcome of internal review. Blair Anderson seconded, and it carried.

5. 22-110-9016 – Chester Mental Health – Blair Anderson made a motion to ratify closing the case as informally resolved. Kathy Rambeau seconded, and it carried.

6. 22-110-9017 – Chester Mental Health – Clarence Russell made a motion to ratify closing the case as informally resolved. Rebecca Lewey seconded, and it carried.

New Complaints:

23-110-9003 State Operated Developmental Center – Alleges inadequate dental care. A peer-to-peer aggression resulted in a tooth injury to the recipient, leaving the tooth loose and out of place. The recipient had a dental appointment which showed a broken root and slight infection. Kathy Rambeau made a motion to accept the complaint for investigation. Blair Anderson seconded, and it carried.

23-110-9004 Housing Authority – Alleges inappropriate eviction and/or eviction process resulting in a recipient with a traumatic brain injury and mental illness being homeless on the streets and a victim of sexual and financial abuse. A release of information was not received after more requests were made. Kathy Rambeau made a motion to not accept the complaint due to not having a release of information after 3 months. Blair Anderson seconded, and it carried.

23-110-9005 Community Mental Health Unit – Alleges inadequate treatment. A recipient with a traumatic brain injury and mental illness was brought in for treatment. The hospital discharged the recipient stating homelessness is not a reason for admission without a proper assessment being done for mental health issues. A release of information was not received after more requests were made. Clarence Russell moved to not accept the complaint for investigation due to not having a release of information after 3 months. Kathy Rambeau seconded, and it carried.

23-110-9006 State Operated Mental Health Facility – alleges a recipient was told he could sign out to be discharged, but later was told he must go to a state operated developmental center to be accepted at a CILA home. Kathy Rambeau made a motion to table case opening to allow time for a release of information to be received. Rebecca Lewey seconded, and it carried.

Unfinished Business: Clarence Russell made a motion to enter closed session at 6:31 p.m. Kathy Rambeau seconded, and it carried.

Case progress was reviewed for 21-110-9011, 21-110-9018, 21-110-9019, 21-110-9020, 21- 110-9021, 22-110-9002, 22-110-9003, 22-110-9004, 22-110-9005, 22-110-9006, 22-110-9007, 22-110-9008, 22-110-9009, 22-110-9010, 22-110-9011, 22-110-9015, 22-110-9018, 22-110- 9019, 22-110-9020, 22-110-9021, 22-110-9022, 23-110-9001 & 23-110-9002. Draft report was reviewed for 21-110-9020. Case closures were considered for 20-110-9003, 20-110-9011, 21- 110-9002, 21-110-9010, 22-110-9001, 22-110-9012, 22-110-9013 & 22-110-9014.

Case Progress Reports:

1. 21-110-9011 TDL Group Inc. - alleges inadequate treatment planning due to recipients not being allowed to return to day services. The case is ready for report.

2. 21-110-9018 Coleman Tri County – alleges the proper process set by the Department of Human Services for returning to day services was not followed. The case is ready for report.

3. 21-110-9019 Southeastern Residential Alternatives CILA – alleges lack of guardian involvement and inadequate care and treatment planning. The case is ready for report.

4. 21-110-9021 Chester Mental Health – alleges inadequate care and inappropriate restriction of rights. The report is in progress.

5. 22-110-9002 Chester Mental Health – alleges inappropriate placement of individuals with intellectual/developmental disabilities and inadequate treatment planning. Records received need to be reviewed. The case is still under investigation.`

6. 22-110-9003 Chester Mental Health – alleges inadequate treatment relating to medication and fitness restoration. Records received need to be reviewed. The case is still under investigation.

7. 22-110-9004 Chester Mental Health – alleges inadequate treatment regarding dietary issues. Records received need to be reviewed. The case is still under investigation.

8. 22-110-9005 Chester Mental Health – alleges inadequate treatment relating to medication. Records received need to be reviewed. The case is still under investigation.

9. 22-110-9006 Chester Mental Health – alleges a patient was petitioned for involuntary medication without justification. Additional records were received and need to be reviewed. The case is still under investigation.

10. 22-110-9007 Choate Mental Health - alleges lack of privacy during visitation and inadequate treatment planning due to unequal pass level privileging between forensic and non-forensic patients. Site visit completed. The case is ready for report.

11. 22-110-9008 Chester Mental Health – alleges inadequate treatment planning due to rehabilitation classes being closed abruptly with on unit only programs available. The case is ready for report.

12. 22-110-9009 Trade Industries – alleges inappropriate restriction of rights for cell phone paid for by recipient. The case is ready for report.

13. 22-110-9010 Choate Mental Health – alleges lack of involvement in treatment planning (dietary) and inadequate grievance process. The case is ready for report.

14. 22-110-9011 Choate Mental Health – alleges inappropriate administration of emergency medication. The report is in progress.

15. 22-110-9015 Chester Mental Health – alleges inappropriate treatment planning relating to court enforced medication. The site investigation needs to be completed.

16. 22-110-9018 Choate Mental Health - alleges inadequate treatment relating to involuntary medication. The site visit was completed. Medication was reportedly not given due to allergic reactions. The case is ready for report.

17. 22-110-9019 Choate Mental Health - alleges inappropriate admission. A patient with a traumatic brain injury is signing self into facility voluntary. The case is ready for report

18. 22-110-9020 Choate Mental Health – alleges inadequate treatment and inappropriate restriction on mail. The site visit was completed. The board discussed the site visit. The case should be ready for report.

19. 22-110-9021 Chester Mental Health – alleges a recipient was not allowed to vote. Alleges staff did not give a 5-day discharge form when requested. The chart needs to be reviewed still. The case is still under investigation.

20. 22-110-9022 Choate Developmental Center – alleges inadequate treatment planning. The team states that a recipient with significant maladaptive behaviors needs to be transferred to another facility but cannot say what services are needed that cannot be received at Choate. The site visit was completed but mor information is needed. The case is still under investigation.

21. 23-110-9001 Chester Mental Health - alleges a recipient is not being served in the least restrictive environment. Alleges lack of guardian involvement by not notifying of treatment meetings and not providing requested information and alleges inadequate care and treatment for diabetes due to glucose levels not being checked, weight loss and overmedication. Site visit needs to be scheduled.

22. 23-110-9002 Chester Mental Health – alleges a recipient is not being served in the least restrictive environment and inadequate care and treatment due to overmedication and inadequate foot care. Site visit needs to be scheduled.

Draft Reports:

1. 21-110-9020 Chester Mental Health – alleges inhumane care due to lack of outside time. The board discussed the draft report and had one addition, to add a timeframe for the additional records request. Kathy Rambeau made a motion to approve to the draft report as revised. Blair Anderson seconded, and it carried

Closures:

1. 20-110-9003 Chester Mental Health - alleges inadequate treatment due to a recipient seeing social worker less than once per month and not being enrolled in any groups or rehabilitation classes. The board reviewed the response from the facility and had no further concerns. Clarence Russell made a motion to close the case and make the report a part of the public record. Blair Anderson seconded, and it carried.

2. 20-110-9011 Chester Mental Health – alleges inadequate treatment planning. The recipient has a date for his final appointment, so the board had no additional concerns. Blair Anderson made a motion to close the case and make the report a part of the public record. Clarence Russell seconded, and it carried.

3. 21-110-9002 Choate Mental Health – Alleges inappropriate placement and inadequate treatment planning. The board reviewed the response and had no additional concerns, but did request that some documentation be sent once completed. Kathy Rambeau made a motion to close the case with a note in the closure letter to request additional documentation once finished. Clarence Russell seconded, and it carried.

4. 21-110-9010 Progressive Housing - alleges inadequate treatment planning due to recipients not being allowed to return to day services. The board reviewed the response and requested an additional policy be provided before closing the case. Kathy Rambeau made a motion to table case closure to continue negotiations. Blair Anderson seconded, and it carried.

5. 22-110-9001 Choate Mental Health – alleges inappropriate restriction of rights. Patients off unit activities and outside walks are dependent on 75% or more participation in programming. The board reviewed the response from the facility stating that the internal review outcome was still pending. Kathy Rambeau made a motion to table case closure pending the outcome of the internal review. Clarence Russell seconded, and it carried.

6. 22-110-9013 Choate Mental Health – alleges inadequate care, inadequate treatment planning & not being served in the least restrictive environment. The board reviewed the response and requested additional documentation. Clarence Russell made a motion to table case closure to continue negotiations. Kathy Rambeau seconded, and it carried.

7. 22-110-9014 Choate Developmental Center – alleges lack of communication with guardian and inappropriate telephone restriction. The board reviewed the response and had no further concerns. Blair Anderson made a motion to close the case and make the report part of the public record. Kathy Rambeau seconded, and it carried.

Other Unfinished Business: The board discussed a board membership and agreed to send a letter to an HRA Member regarding continued participation.

Clarence Russell made a motion to return to open session at 8:21 p.m. Rebecca Lewey seconded, and it carried.

The next meeting is scheduled for 5:00 p.m. on November 17th in Anna.

Clarence Russell made a motion to adjourn the meeting at 8:38 p.m. Paul Jones seconded, and it carried.
