Illinois Educational Labor Relations Board met Sept. 20.

Here are the minutes provided by the board:

I. PRESENT

Chairman Lara Shayne (Chicago); Board Member Michelle Ishmael (Springfield); Board Member Steve Grossman (Chicago); Board Member Chad Hays (Springfield); Executive Director Victor Blackwell (Chicago); General Counsel Ellen Strizak (Chicago); Assistant General Counsel Dawn Harden (Chicago); Staff Attorney Nick Gutierrez (Chicago); Staff Member Meredith Dean (Springfield); Staff Member Cathy Banks (Chicago).

II. OPENING STATEMENT AND BOARD MEMBER ATTENDANCE

Chairman Shayne made a statement regarding the meeting venue then took attendance. All Board Members present.

III. APPROVAL OF OPEN AND CLOSED MINUTES OF BOARD MEETING HELD August 16, 2023

Chairman Shayne called for a motion to approve the open minutes from the August 16, 2023, Board Meeting. Board Member Ishmael so moved to approve the open minutes of the August 16, 2023, Board meeting. Board Member Hays seconded. The Board passed the motion unanimously by roll call vote.

Chairman Shayne called for a motion to approve the closed minutes from the August 16, 2023, Board Meeting. Board Member Hays so moved to approve the closed minutes of the August 16, 2023, Board meeting. Board Member Grossman seconded. The Board passed the motion unanimously by roll call vote.

IV. CASES

Teamsters Local 700/Board of Trustees of the University of Illinois, Case No. 2019- CA-0060-C

Chairman Shayne called the case. The case is before the Board on exceptions to an Administrative Law Judge’s (ALJ) Recommended Decision and Order. Assistant General Counsel Harden presented a memo on the case and recommended that the Board affirm the ALJ decision with modification to the recommended remedy. Chairman Shayne directed the Assistant General Counsel to draft an opinion and order consistent with her memo and the Board’s discussion.

Morris/CBE, Case No. 2022-CA-0081-C

Chairman Shayne called the case. The case is before the Board on exceptions to an Executive Director’s Recommended Decision and Order. General Counsel Strizak drafted an Opinion and Order based on the discussion during last month’s meeting. Chairman Shayne called for a motion for the Board to adopt and issue the draft Opinion and Order

(with change identified by Chairman and Member Grossman). Board Member Grossman so moved, and Board Member Ishmael seconded the motion. The Board voted to issue the Opinion and Order unanimously and the motion passed by roll call vote.

V. FINAL ORDER CASES

Board of Trustees Univ. of Illinois/IUOE, Local 399, AFL-CIO, Case No. 2022-UC 0034-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Hays so moved, and Board Member Grossman seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Board of Trustees Univ. of Illinois/SEIU, Local 73, SOL, CLC, Case No. 2022-UC 0025-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Grossman so moved, and Board Member Ishmael seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Sinkevicius/Chicago Board of Education, Case No. 2022-CA-0021-C The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Hays so moved, and Board Member Grossman seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Illini Central CUSD #189/Illini Central Educ. Association, IEA-NEA, Case No. 2022- UC-0033-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Ishmael so moved, and Board Member Grossman seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Vacek/AFSCME Council 31, Case No. 2022-CB-0004-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Ishmael so moved, and Board Member Hays seconded the motion (with footnote to reflect correct filing date). The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Vacek/Valley View Community Unit School District 365-U, Case No. 2022-CA-0038- C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Hays so moved, and Board Member Ishmael seconded the motion (with footnote to reflect correct filing date). The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Brookfield-LaGrange SD 95/Brookfield Educ. Association, IEA-NEA, Case No. 2023- UC-0007-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Grossman so moved, and Board Member Ishmael seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Belvidere SD No. 100/Belvidere Education Support Team, IEA-NEA, Case No. 2023- UC-0011-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Hays so moved, and Board Member Grossman

seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

Granite City CUSD #9/Granite City Fed. Sec. Emp., L4956, IFT-AFT, AFL-CIO, Case No. 2023-AC-0002-C

The case is before the Board on an unappealed Executive Director’s Recommended Decision and Order. Assistant General Counsel Harden presented the case. Chairman Shayne called for a motion for the Board not to take the case up on its own motion and to issue a final order. Board Member Grossman so moved, and Board Member Ishmael seconded the motion. The Board voted unanimously and the motion passed by roll call vote not to take the case up on its own motion and to issue a final order.

VII. BUDGET/FISCAL

Staff Member Meredith Dean presented budget and fiscal information.

VIII. CASE STATUS REPORT

Executive Director Victor Blackwell presented information from the case status report.

IX. STRIKE REPORT UPDATE

Executive Director Blackwell advised there was nothing to report.

X. LEGISLATIVE UPDATE

Staff Attorney Gutierrez advised there was nothing to report aside from the approaching Veto Session in October.

XI. LITIGATION UPDATE

General Counsel Strizak advised the Board on appellate court updates.

XII. PROPOSED IELRB RULES CHANGES UPDATE

General Counsel Strizak advised the Board of the comment and objection filed during the 45 day comment period and a discussion ensued. Ellen will email 2nd notice changes to the Board in accordance with the discussion.

XIII. AGENCY OPERATIONS

Executive Director Blackwell advised the Board concerning personnel, budget pressures from the Governors office inquiry and response, and R-Case processing status.

XIV. SPECIAL ANNOUNCEMENT

Member Ishmael was granted a moment of personal privilege from the Chairman to acknowledge the anniversary of the Illinois Educational Labor Relations Act, as well as 3 trailblazers and Education giants who we recently lost.

XV. CLOSED

Chairman Shayne called for a motion to go into closed session. Board Member Hays so moved, and Board Member Ishmael seconded the motion. The Board voted unanimously by roll call vote and the meeting went into closed session.

XVI. RECONVENE

Chairman Shayne called for a motion to reconvene the meeting. Board Member Ishmael so moved, and Board Member Grossman seconded the motion. The Board voted unanimously by roll call vote to reconvene the meeting and the motion passed.

XVII. ADJOURN

Chairman Shayne called for a motion to adjourn the meeting. Board Member Ishmael so moved, and Board Member Hays seconded the motion. The Board voted unanimously by roll call vote to adjourn the meeting and the motion passed.
