Illinois gun rights case advances in appellate court

The Illinois State Rifle Association (ISRA) has submitted a brief to the Seventh Circuit Court of Appeals concerning the consolidated cases of Schoenthal et al v. Raoul and Schoenthal et al v. Eileen O’Neil Burke. The case addresses the rights of licensed concealed carry holders on public transportation.

Eileen O’Neil Burke, recently elected as Cook County States Attorney, replaces Kimberly Foxx as a defendant in this legal matter.

Previously, the plaintiffs, Schoenthal et al, secured a favorable ruling in the U.S. District Court for the Northern District of Illinois, Western Division on August 30, 2024. Following this decision, the case has moved to the Seventh Circuit Court of Appeals.

The ISRA expressed optimism regarding the upcoming verdict from the Seventh Circuit and anticipates that "this case to eventually be heard by the Supreme Court of the United States."
